1. Definitions

• "Credit Provider" refers to a third-party financial institution or registered lender.
• "User Data" refers to the personal and financial information you provide in our application forms.
• "POPIA" refers to the Protection of Personal Information Act 4 of 2013 (South Africa).

2. Our Role: We are a Matchmaker, Not a Lender

• MoneyHello is not a credit provider, a bank, or a financial advisor.
• Our service is strictly limited to connecting you with potential lenders.
• We do not issue loans, we do not determine your creditworthiness, and we do not guarantee that any lender will approve your application.
• Any loan agreement you sign is strictly between you and the Credit Provider. We are not a party to that contract.

3. User Eligibility & Responsibilities

By using our Service, you warrant that:

• You are at least 18 years old and a legal resident of South Africa.
• The information you provide is 100% accurate. Providing false information may be considered fraud.
• You will use the service for personal, non-commercial purposes only.
• You understand that MoneyHello does not provide financial advice. You are encouraged to seek independent advice before entering into any credit agreement.

4. Consent for Data Processing & Marketing (POPIA)

In compliance with POPIA, you acknowledge and agree that:

• Data Sharing: By clicking "Submit" or "Get Offers," you provide your express consent for SIA FINLEADGLOBAL to share your personal information with its network of partners and Credit Providers.
• Soft Searches: You authorize Credit Providers to perform "soft" credit inquiries to determine your eligibility. These do not affect your credit score.
• Marketing Communications: You consent to receive marketing communications (SMS, email, or telephone) from us and our partners regarding financial products. You may opt-out at any time via the "Unsubscribe" link in any communication.

5. Intellectual Property

All website content, including the "MoneyHello" brand, logos, text, and proprietary matching algorithms, is the property of SIA FINLEADGLOBAL. You may not scrape, copy, or redistribute any part of this site without our written consent.

6. Limitation of Liability & Indemnification

• As-Is Basis: The Service is provided "as is" without any warranties of any kind.
• Third-Party Actions: We are not liable for any losses, damages, or costs incurred as a result of your interactions with a Credit Provider, including their interest rates, fees, or collection methods.
• Technical Errors: We do not guarantee that the website will be error-free or uninterrupted.
• Indemnity: You agree to indemnify SIA FINLEADGLOBAL against any claims or legal fees arising from your breach of these Terms.

7. Governing Law & Dispute Resolution

• Jurisdiction: These Terms are governed by the laws of the Republic of Latvia.
• Local Compliance: Notwithstanding the above, we acknowledge the mandatory consumer protection laws of the Republic of South Africa (NCA and POPIA).
• Arbitration: Any disputes shall first be attempted to be resolved via mediation. If unsuccessful, the dispute shall be settled in the competent courts of Riga, Latvia.

8. Amendments

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon being posted on the website. Your continued use of the site constitutes acceptance of the updated Terms.
